Total loss appraisals

When the settlement offer doesn't add up

When an insurer declares your vehicle a total loss, they owe you its actual cash value — what it was genuinely worth the moment before the crash. That number comes from their valuation vendor, and it frequently trails the real market: the comparables skew low, the options and condition get averaged away, and the offer lands hundreds or thousands below what replacing your vehicle actually costs.

We prepare an independent actual-cash-value appraisal — built from licensed valuation data and documented comparable sales, adjusted to your exact vehicle, and signed by a credentialed appraiser. The same evidence standards and the same published methodology as every report we issue.

Owners use it to evaluate the offer before accepting, to support negotiation — their own or their attorney's — and, where a policy provides an appraisal clause, as the owner-appointed appraisal that clause calls for.

Arizona vehicle owners' rights

The law is on the owner's side — twice

Diminished value

Is diminished value recoverable in Arizona?

Yes. Arizona courts have long recognized that a properly repaired vehicle can still be worth less than before the loss (Oliver v. Henry), and that the difference is recoverable in a third-party claim against the at-fault driver's insurer.

What's the deadline?

Property damage claims in Arizona carry a two-year statute of limitations from the date of loss. The appraisal takes days — but don't sit on a claim.

Who actually pays?

The at-fault driver's insurance carrier. Diminished value is a third-party claim — your own policy is generally not the payer, which is why fault matters in our eligibility questions.

What you'll need

The at-fault carrier and claim number, the final repair invoice, and photos of the repaired vehicle. We handle the market data, the comparables, and the math.

Total loss

The insurer owes actual cash value

A total loss settlement must reflect the vehicle's actual cash value — its real market worth at the date of loss — not a vendor average that happens to be convenient. [ATTORNEY REVIEW]

You may obtain your own appraisal

Nothing obligates you to accept the insurer's valuation as the last word. An owner may obtain an independent appraisal — and many policies contain an appraisal clause that gives a formally appointed appraisal standing in resolving the disagreement. [ATTORNEY REVIEW]

We prepare independent appraisals — for both services. We do not negotiate or settle claims — you or your attorney submit the report. This page is general information, not legal advice.

FAQ

Straight answers

What is diminished value?
The gap between what your vehicle was worth before the accident and what a buyer will pay for it now — after a complete, proper repair — purely because it carries an accident record. It's real, it's measurable, and in Arizona it's recoverable.
Who pays it?
The at-fault driver's insurance carrier. It's a third-party claim: their driver damaged your property, and the loss in market value is part of that damage.
How long does it take?
3–5 business days once your final repair bill and photos are in. Rush handling is available when a settlement clock is running.
What do you need from me?
The at-fault carrier and claim number, your final repair invoice (the paid one, with supplements), six photos of the vehicle from your phone, and answers to a short condition questionnaire.
Do you negotiate with the insurance company?
No — and be wary of anyone who both values the claim and negotiates it. We produce the independent evidence. You or your attorney submit it and negotiate the settlement; we can refer you to attorneys who handle DV claims regularly.
What if my claim is denied?
The report doesn't expire and the fingerprint keeps it verifiable — it's built to hold up if your attorney escalates. Denials at the adjuster level are commonly revisited once a credentialed, data-backed appraisal is in the file.
My car was totaled and the offer seems low — can you help?
Yes — that's our total loss appraisal. We determine the vehicle's actual cash value at the date of loss from licensed data and documented comparable sales, and put it in a signed report you can weigh the offer against, negotiate with, or use under your policy's appraisal clause.
What's the difference between a diminished value appraisal and a total loss appraisal?
Diminished value applies when your vehicle was repaired: it measures the value the accident record still costs you at resale. A total loss appraisal applies when the vehicle was totaled: it establishes what the vehicle was actually worth, so you can evaluate the insurer's settlement offer. Same engine, same evidence standards — different question.
Will the insurance company accept your appraisal?
Our report is independent, signed evidence — licensed data, disclosed math, a credentialed signature, and a verifiable fingerprint. What a carrier does with it depends on the claim, and the negotiation is handled by you or your attorney; we never promise a settlement outcome, and you should be wary of anyone who does.
Do you work outside Arizona?
Our practice and this site focus on Arizona claims and Arizona law. If your loss happened in another state, contact us — recoverability varies by state, and we'll tell you honestly whether we can help.
